Is it possible this can be addressed?
Here Sitebeam also pick up on the fact my site scores a big fat zero for w3c compliance.
So this morning while awaiting an answer on my two open tickets I took to checking out some other places for answers and I stumbled across this from the Envato Market site which clearly states themes should be w3c compliant: All author-generated HTML needs to be validated via the W3C validator.

The envato staff quoted this:
All author-generated HTML needs to be validated via the W3C validator. However, browser prefixes and any other cutting edge code will be exempt.
Most premium themes in the market will not pass the compliance test due to the complexity of the features or options available (animations, sliders, lightboxes, browser compatibility fixes etc). I’ll be more worried about my site content for SEO instead of a lingering paragraph tag warning on a not so valid validator.
