Permission to use theme on a development server?

Hi, I am setting up a test and development server for my site and was hoping that I can load the theme on there without having to purchase a second license since the second copy will only be used to testing and development purposes. It will sit on a sub-domain of the live site, but will be hosted on a different server and different hosting company, so the IP address, etc. will be different.
